Cole Surveillance & Investigation 102 Hartman Drive, Suite 109 Lebanon, TN 37087 Service Agreement I, __________________________, the undersigned hereinafter called the Client, hereby agree to employ the services of Cole Surveillance and Investigation, hereinafter called CSI a Private Investigation Agency, duly licensed under the Laws of the State of Tennessee to perform private Investigative services, on behalf of the Client. CONFIDENTIAL information supplied to client may NOT be used for purposes that may cause physical or emotional harm to the subject or for any criminal acts such as stalking, harassing, etc. CSI is not responsible for errors or omissions or any unforeseen phenomenons, i.e.: acts of God, client’s miscalculations/misinformation, subject’s acts/events or elements/factors that are not directly within the control of CSI. The client agrees to hold harmless CSI and/or its agents and employees from any and all actions or causes, claims, damages, and demands of whatever type arising directly from the investigation and/or information requested. Client agrees to pay CSI a minimum non-refundable retainer fee of $750.00. CSI agrees to notify the Client prior to the initial retainer being exhausted, and obtain an additional minimum amount of $500.00 to be paid by the client before proceeding with further work on the case. One hour is deducted from your retainer for: Setting up the case file/ agent’s mapping, copies, etc… One hour is deducted from your retainer for: The investigators typed report/notes, still photos, and DVD. CSI does not charge a mileage charge or time driving to the targets location. If the agent follows the target a sixty cents per mile is charged and deducted from your retainer. It is understood that the initial retainer fee will be exhausted at the rate of $85.00 per hour (2 hour minimum) for the primary investigator and $50.00 per hour for each additional investigator. CSI will determine if more than one investigator is needed on a case. More investigators will give you a better chance of obtaining the information needed. Other expense related to the Clients case will be deducted from the retainer. Examples of additional charges could include internet research, courthouse searches, parking, DVD dubbing, phone searches, tag searches, investigation package shipping, etc… The investigation package can be mailed to you or to your attorney. Some information must be mailed to your attorney due to privacy laws. It is understood and agreed that the above stated fees cover CSI’s fees for the investigative stage of the case only, and if a matter goes to court, CSI’s fees for an investigator to appear as a witness in any proceeding shall be $75.00 per hour per investigator (2 Hour Minimum) and 1 hour case review prior to court and shall be in addition to the above stated fees. Court fee must be paid 48 hours prior to court. The Client agrees that any unpaid balance will be paid in full to CSI prior to the release of any information including photographs, video recordings, or other products of the investigation. Client shall be responsible for any and all costs of collection (whether or not legal action is actually commenced) with respect to any and all amounts due and owing to CSI including any and all court costs and reasonable attorneys fees. If CSI feels that the client has in any manner places the investigation in jeopardy, CSI may terminate the investigation at any time without refund.
